Basic eligibility criteria of adjudicators
1. Professional Qualification
- Architect, Engineer, Surveyor with HKIA Membership/ HKIE/HKIS Corporate Membership;
- Registered Architect/ Registered Professional Engineer/ Registered Professional Surveyor; or
- Legal professional holding a valid practising certificate issued by Law Society of Hong Kong/ Hong Kong Bar Association;
2. Post-qualification experience
(i) Adjudicators
- 7 years of post-qualification experience in contract administration related experience (including experience in claim assessment, variation valuation, dispute resolution and construction litigation including providing related advice); and
- 5 years of local experience in preparing/ assessing contractual claims or dispute resolution relating to construction contracts;
(ii) Senior Adjudicators
- 12 years of post-qualification experience in contract administration related experience (including experience in claim assessment, variation valuation, dispute resolution and construction litigation including providing related advice); and
- 10 years of local experience in preparing/ assessing contractual claims or dispute resolution relating to construction contracts;
3. Integrity
Has not been found guilty by a Court of corruption and dishonesty-related offences (e.g. fraud, conspiracy to defraud) or by a disciplinary tribunal of misconduct.
4. Training
Successfully completed trainings conducted/recognised by the ANB in the past 4 years immediately preceding the application; and
5. Others
Satisfied the ANB that the applicant is suitable and competent to exercise the duties of an adjudicator.
Remark: ANB could propose additional or more stringent eligibility criteria than the above basic eligibility criteria. For instance, ANB could propose a more stringent eligibility criteria on integrity that the applicant has not been convicted of an offence of such a nature that, in the opinion of ANB, render him/her not suitable to be an adjudicator.
