Overview:
The Basic Housing Units Ordinance (Cap. 658) will come into effect on 1 March 2026 (except for the provisions concerning the offence of illegal letting of subdivided units (SDUs), which will come into effect on 1 March 2027). The Ordinance seeks to introduce a regulatory regime for the letting of SDUs in residential buildings (i.e. the BHU regulatory regime) under which SDUs in residential buildings have to comply with a set of minimum standards of living conditions and obtain BHU recognition before they can be legally let out for habitation. This aims to ensure the provision of safe, hygienic and reasonable living conditions in SDUs. An application for BHU recognition must be accompanied by a report certified by a specified professional to confirm compliance with the minimum standards of living conditions as well as compliance with certain statutory orders/directions/notices. A specified professional means a registered architect, a registered professional engineer (under the building, civil, structural, fire or building services discipline) or a registered professional surveyor (under the building surveying division).
The speaker(s) from the Housing Bureau will provide a brief introduction of the BHU regulatory regime and will elaborate on the detailed requirements of the minimum standards of living conditions, statutory orders/directions/notices that require attention, and how a specified professional should prepare his/her certification report to support an application for BHU recognition.
